Seriously need some advice

Guys, I've got a real dilemma...
long story short, bought a used car from a Ford dealership, checked carfax everything looked ok (no accidents, carfax certified, etc..) and took the car home. Financed the car through Chase so on my title it says me and Chase. Its been a year and my reg renewal never comes so now its past due. Call DMV to find out somebody started an app to transfer the title to their name, but never completed so basically I cant renew my reg until the dealership closes this app. Talked to the DMV person over the phone and most likely the car that I bought from this Ford dealership had a lien that was never cleared so obviously the original lien holder is trying to take my car back...does anyone on this forum know what action needs to be taken from now?? Its most likely that the wholesaler/previous owner traded in the car but still owed money on it but this Ford dealer sold the car to me not disclosing/clearing the title and so what now? Cant renew my reg so cant drive the car anymore....lets hear it guys...thanks

Sorry to hear that. A dealership in S. Cal did the same exact thing to a number of buyers. A local TV station got involved and some of the buyers were able to get resolution in part or in whole. In the local case, the used car dealer took the car in trade and was too 'pay off' the lien holder while he wrote a new contract on the car he sold. The dealer never paid off the lien holder so the previous owner is still on the hook for paying the loan balance on their old car and the new owner is out the money they paid for a car that is still not theirs in the eyes of the law. I hope in your case this can be resolved easily and quickly.

You're not in MN are you (Hecker dealer?)-
what will need to happen is that you will need to take your copies of RIC (retail instalment contract with Chase), Purchase Order from the dealer, signed title app to the DMV and show that you are the secondary lien holder (Chase being the primary)-the bad news is-if the Ford dealer did not satisfy the prev lien on the title-either Chase or yourself will need to pay the balance (this can be settled/lowered) to remove the orig lien holder, so that Chase and yourself can be listed-
also contact Chase and let them know that this has happened-they wont be thrilled to learn they paid a dealer 100% for a car they dont "own".

thanks for the offer but I'm out here in Cali...but the funny thing is on the registration card issued by the DMV only me and Chase are listed. If it ever comes down to taking legal action, what grounds do I have or am I just out of my $$ like buying stolen property??

The new lien card was issued by Chase-it wont be valid becuase if you go into the DMV to remove a lien-the orig party will show up (here at my company we can actually issue our own MN lien cards and send them to customers after filing with the state-they sadly mean nothing if the title or records do not match to a T).
Worse case scenario-you give the car back and have to go after the dealer in small claims for your down payment (if you traded in a car-goodluck on getting that back)-google Denny Hecker Trial here in MN-very similar things are happening here-and most customers are SOL and have to go after the dealer.
There is a chance its just a paperwork error and they are slow-you didnt buy stolen prop-but who ever traded the car in to the dealer (or if they bought it at the auction-they should have cleared the title prior to sale) should have checked to see if there were any liens on the trade prior to placing it for sale-

You must have a receipt, bill of sale, etc. No? Take it up further in the management - and call Chase, they may be able to help.

So I guess the worst case scenario would be me and the dealership in small-claims court...Sure hoping that paperwork error is all that is, talked to the people over at DMV and they actually wanted to see the car in person "to make sure I still have possession of the vehicle" and when I asked them how with an expired reg. tag "that would be your problem" was the answer!! gotta love them at DMV....just hope they're not gonna see the car in person and tell me that they're now gonna confiscate it to give back to the original owner/lien holder!!!

The DMV wont repo your car-they have no authority over that-if they are pricks, they could call the 5-0 to let them know you are driving on expired tags (car gets impounded until they are current)-but I doubt that would happen.
Take it over to them and show it to them so that they know you have it (if you're still uncomfortable with that idea-maybe a pic with your DL, you, and todays paper would work).
